Chartie Terms of Use

These terms explain the rules for using Chartie, including its AI-generated chart analysis, market data, subscriptions, and saved content.

By accessing or using Chartie, you agree to these Terms and our Privacy Policy. If you do not agree, do not use the Service.

1. Agreement to these Terms

These Terms of Use (“Terms”) are a binding agreement between you and Gokhan Akcay, the developer and operator of Chartie (“Chartie,” “we,” “us,” or “our”), concerning your access to and use of the Chartie mobile application, its application programming interface, related websites, subscriptions, content, and services (collectively, the “Service”).

By accessing or using any part of the Service, you agree to these Terms. If you do not agree, you must not access or use the Service.

2. Eligibility

You must be legally capable of entering into these Terms. If you are under the age of legal majority where you live, you may use the Service only with the permission and supervision of a parent or legal guardian who agrees to these Terms.

You represent that your use of the Service is lawful in your location and that you are not prohibited from receiving the Service under applicable trade, sanctions, or export-control laws.

3. The Service

Chartie lets you search supported financial instruments, view chart data, capture or select a chart image, and request automated technical chart interpretation. Depending on the current product configuration and your subscription, features may include market structure summaries, visible support and resistance levels, conditional bullish and bearish scenarios, risk factors, favorites, and private analysis history.

Chartie Mentor may provide a bounded educational conversation about trading concepts, chart interpretation, and risk management. It does not have live market, news, account, portfolio, or broker data and does not make personal trading decisions for you.

Chartie does not hold customer funds, connect to brokerage accounts, execute orders, provide custody, operate an exchange, or act as a broker, dealer, investment adviser, portfolio manager, fiduciary, or tax or legal adviser.

4. No financial or investment advice

All content produced or displayed by Chartie is general, informational, and educational. It is not individualized financial, investment, trading, legal, accounting, or tax advice and is not a recommendation or solicitation to buy, sell, hold, or otherwise transact in any security, cryptocurrency, currency, derivative, or other financial instrument.

Technical analysis is inherently uncertain. Markets can move rapidly, historical patterns may not repeat, and losses may exceed expectations. You are solely responsible for evaluating information, obtaining advice from appropriately licensed professionals, and making your own decisions. You should not make a financial decision solely because of a Chartie output.

Chartie does not know your objectives, financial circumstances, experience, risk tolerance, portfolio, tax position, or other facts needed to assess whether any action is suitable for you.

Mentor conversations are educational explanations and examples, not individualized recommendations. Do not treat a chat response as an instruction to buy, sell, hold, enter, exit, or size a position.

5. AI outputs and market data

Chartie uses automated systems, including third-party artificial intelligence services, to interpret the chart image and context you submit. AI-generated outputs are probabilistic and may be inaccurate, incomplete, inconsistent, outdated, misleading, or unavailable. They may misread symbols, prices, timeframes, indicators, patterns, labels, or visual artifacts.

Market prices, instrument details, charts, logos, and other market information may come from third-party providers. Such information may be delayed, adjusted, interrupted, or incorrect and may differ from data available through an exchange, broker, or other source. Chartie does not guarantee that any displayed price is executable.

News-card illustrations may be generated by AI from public article metadata. They are illustrative, may not depict the reported event, person, company, or market accurately, and must not be treated as documentary evidence or a market prediction.

You must independently verify any output or market information that could influence a financial or other significant decision. No confidence score, scenario, price level, target, or risk factor is a prediction, guarantee, or promise of future performance.

6. Your charts and other content

You retain any ownership rights you have in chart images and other content you submit (“User Content”). You grant Chartie a non-exclusive, worldwide, royalty-free license to host, transmit, reproduce, resize, convert, and process User Content only as needed to provide, secure, troubleshoot, and maintain the Service. This license includes permission to use service providers that process User Content on our behalf.

The operational license ends when the relevant processing and legally required retention end, except for content you choose to keep in private app history and limited copies that providers may retain under their applicable policies. Our Privacy Policy explains data processing and retention in more detail.

You represent that you have all rights and permissions needed to submit User Content and that our permitted processing will not violate law, confidentiality duties, privacy rights, or intellectual property rights. Do not submit account credentials, personal financial records, or other sensitive personal information that is not necessary for chart analysis.

7. Acceptable use

You may not use or attempt to use the Service to:

  • violate any law, regulation, court order, or third-party right;
  • upload unlawful, infringing, deceptive, malicious, or unauthorized content;
  • bypass authentication, subscription controls, rate limits, or security measures;
  • probe, scan, disrupt, overload, damage, or gain unauthorized access to the Service or related systems;
  • introduce malware or use the Service to facilitate fraud, manipulation, harassment, or other harmful conduct;
  • scrape, crawl, copy, resell, sublicense, or commercially redistribute the Service or its outputs without our written permission;
  • reverse engineer, decompile, disassemble, or attempt to derive source code, except to the limited extent applicable law expressly permits;
  • use automated means to access the Service except through an interface we expressly authorize; or
  • misrepresent AI-generated content as verified, guaranteed, or personalized professional advice from Chartie.

We may apply reasonable technical limits and take steps to investigate or prevent suspected misuse.

8. Subscriptions, renewal, and cancellation

Some features require an auto-renewable subscription purchased through Apple’s App Store. Available plans, duration, included features, localized price, billing period, and any trial or introductory offer are shown in the purchase screen before you confirm a transaction. Those purchase-screen terms form part of these Terms.

  • Payment is charged to your Apple Account when Apple confirms the purchase.
  • Your subscription renews automatically for the selected period unless you cancel it before renewal in accordance with Apple’s displayed terms.
  • You can manage or cancel a subscription in your Apple Account subscription settings. Deleting Chartie does not cancel an active subscription.
  • Price changes, renewal notices, billing recovery, taxes, and any required consent are handled under Apple’s applicable terms and App Store rules.
  • Refund requests are administered by Apple, subject to applicable law and Apple’s refund policies. Nothing in these Terms limits a non-waivable refund or withdrawal right.

If a subscription expires or is canceled, paid access continues through the period recognized by Apple and then ends. Features that do not require an active subscription may remain available.

9. Third-party services

The Service depends on or links to services provided by Apple, OpenAI, Google Firebase, Twelve Data, Cloudflare, and other hosting, infrastructure, market-data, or security providers. Their services are governed by their own terms and policies. Chartie does not control and is not responsible for third-party services, content, availability, security, or decisions.

A link or integration does not imply endorsement. Third-party services may change or stop operating, which may affect Chartie features.

10. Chartie ownership and license

Chartie and its licensors own the Service, including its software, visual design, branding, documentation, compilation of content, and all related intellectual property rights, excluding User Content and third-party materials.

Subject to these Terms, we grant you a limited, personal, revocable, non-exclusive, non-transferable license to use the Service for its intended purpose. No other right or license is granted.

If you voluntarily send feedback or suggestions, you grant us a worldwide, perpetual, irrevocable, royalty-free right to use them without restriction or compensation, provided we do not publicly identify you without permission.

Third-party trademarks and logos

Company names, instrument symbols, logos, trademarks, service marks, and other brand identifiers displayed through the Service belong to their respective owners. Chartie displays these materials solely to identify the relevant company, issuer, asset, product, or service. Their display does not imply affiliation with, sponsorship by, or endorsement of Chartie by any trademark owner.

No ownership interest or license in any third-party mark is granted to you. You may not extract, copy, redistribute, or separately use those materials except as permitted by the applicable owner or by law.

11. Availability and changes to the Service

We may add, modify, limit, suspend, or remove features; change supported instruments, providers, models, quotas, or technical requirements; perform maintenance; or discontinue all or part of the Service. We do not guarantee continuous, error-free, or universal availability.

We will take reasonable steps to avoid unfairly depriving active subscribers of paid service and will follow applicable law and Apple’s subscription requirements when changes materially affect a subscription.

12. Suspension and termination

You may stop using Chartie at any time. You remain responsible for canceling an active subscription through Apple.

We may restrict, suspend, or terminate access if we reasonably believe you violated these Terms, created security or legal risk, failed to pay through the applicable store, abused the Service, or if continued operation is no longer commercially or technically feasible. Where appropriate, we will provide notice and a reasonable opportunity to address the issue.

Provisions that by their nature should survive termination—including ownership, disclaimers, liability limitations, dispute provisions, and accrued payment obligations—will survive.

13. Disclaimers

To the maximum extent permitted by law, the Service is provided “as is” and “as available.” Chartie disclaims all express, implied, and statutory warranties, including warranties of merchantability, satisfactory quality, fitness for a particular purpose, title, non-infringement, accuracy, availability, and results.

We do not warrant that the Service or any AI output, price, chart, signal, scenario, target, level, or other content will be accurate, complete, current, secure, uninterrupted, profitable, or suitable for your needs. No statement creates a guarantee of performance or outcome.

Some jurisdictions do not allow certain warranty exclusions. In those jurisdictions, exclusions apply only to the extent permitted, and your mandatory statutory rights remain unaffected.

14. Limitation of liability

To the maximum extent permitted by law, Chartie and its developer, affiliates, licensors, and service providers will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages; loss of profits, revenue, opportunities, goodwill, or data; trading or investment losses; or losses arising from reliance on an AI output or market data.

To the maximum extent permitted by law, Chartie’s total aggregate liability arising out of or relating to the Service or these Terms will not exceed the greater of the amount you paid for Chartie during the twelve months before the event giving rise to the claim or the equivalent of USD 50.

These limitations do not exclude liability that cannot lawfully be limited, including liability for fraud, willful misconduct, gross negligence where applicable, or death or personal injury caused by negligence. They also do not limit mandatory consumer remedies.

15. Governing law and disputes

Before filing a formal claim, please contact us and give both sides a reasonable opportunity to resolve the issue informally.

To the extent a choice of law is permitted, these Terms are governed by the laws of the Republic of Türkiye, without regard to conflict-of-law rules. Subject to mandatory consumer protections, courts located in Istanbul, Türkiye will have jurisdiction.

If you are a consumer, nothing in these Terms deprives you of non-waivable protections provided by the laws of your usual country of residence or any right to bring a claim before a competent local court or consumer authority where applicable law permits.

If any provision is found unenforceable, it will be enforced to the greatest lawful extent and the remaining provisions will continue in effect. Our failure to enforce a provision is not a waiver. You may not assign these Terms without our consent; we may assign them in connection with a reorganization, financing, sale, or transfer of the Service, subject to applicable law.

These Terms and the policies expressly referenced in them are the entire agreement between you and Chartie regarding the Service.

16. Changes to these Terms

We may update these Terms to reflect changes to the Service, providers, law, or business practices. We will post the updated Terms here and revise the effective date. For material changes, we will provide additional notice when reasonably appropriate or legally required.

Changes apply prospectively. By continuing to use the Service after updated Terms take effect, you accept them. If you do not agree, you must stop using the Service and cancel any subscription before its next renewal.
